NorthStar Hydraulics Inc. (“NorthStar”, “we”, “us”, or “our”)

These Terms and Conditions (“Terms”) govern all transactions between NorthStar Hydraulics Inc. and the customer (“Customer”, “you”, or “your”) for the purchase of products and services through our website or direct sales channels. By placing an order, you agree to be bound by these Terms, as well as our Privacy Policy and Return Policy.

1. Definitions

• "Products": All hydraulic cylinders, components, parts, and related goods manufactured or distributed by NorthStar.

• "Purchase Order": All written, emailed, or verbal order confirmations accepted by NorthStar, including online transactions.

• "Customer": Any individual or business entity placing an order with NorthStar.

2. Pricing and Taxes

All prices are listed in Canadian dollars (CAD) and are subject to change without notice. Prices exclude applicable provincial and federal taxes, which will be added at checkout unless valid exemption documentation is provided.

Import duties, customs fees, or provincial eco/environmental fees (if applicable) are the responsibility of the Customer.

3. Payment Terms

Unless otherwise agreed in writing, payment is due in full prior to shipment. We accept major credit cards and other secure electronic payments via our third-party payment processor.

Credit terms may be offered to established customers with approved accounts. Overdue balances are subject to a monthly interest charge of 1.5% (or the maximum allowable by law).

4. Order Fulfillment and Shipping

Orders are processed and shipped from our Canadian warehouse Monday to Friday, excluding statutory holidays.

• Standard shipping estimates and delivery timeframes are provided at checkout.

• Shipping costs are calculated based on weight, dimensions, and destination.

• Risk of loss passes to the Customer upon carrier pickup or local delivery.

• NorthStar is not liable for shipping delays caused by carriers, weather, customs, or other forces beyond our control.

5. Custom Orders and Special Products

• Custom-built or modified products (including cut rods, custom-length cylinders, or OEM-specific builds) are final sale and non-refundable.

• Custom orders may require a non-refundable deposit. Once production has started, cancellations will not be accepted.

6. Returns and Exchanges

Refer to our official Return Policy for full details.

• Products may be returned within 15 days for refund or exchange.

• Returns requested after 15 days and up to 45 days are subject to a 20% restocking fee.

• Returns after 45 days are not accepted.

• All items must be unused, in original condition and packaging, and accompanied by a valid RMA number.

• Special orders, gas-powered items that have been used or fueled, and custom components are not eligible for return.

7. Product Warranty

NorthStar Hydraulics warrants its products against manufacturing defects in materials and workmanship for a period of one (1) year from the date of purchase.

This warranty does not cover:

• Damage caused by improper use, installation, maintenance, or storage

• Wear-and-tear or misuse

• Unauthorized repairs or modifications

Warranty claims require a written description of the issue and a valid RMA. We reserve the right to inspect and determine eligibility for refund, repair, or replacement.

8. Limitation of Liability

To the fullest extent permitted by law, NorthStar shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profit, business interruption, or personal injury resulting from use of our products.

Our total liability shall not exceed the purchase price paid for the affected product.

9. Intellectual Property

All content on our website, including logos, images, product descriptions, and designs, is the property of NorthStar Hydraulics Inc. and may not be used or reproduced without written permission.

10. Force Majeure

NorthStar shall not be held liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to: natural disasters, transportation delays, labour disputes, global supply disruptions, or government restrictions.

11. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

12. Amendments and Updates

NorthStar reserves the right to update these Terms at any time. Changes will be posted on our website and will apply to all transactions made thereafter.
