These Terms and Conditions (“Terms”) govern all purchases made through NorthStar Hydraulics Inc. (“NorthStar,” “we,” “us,” or “our”), whether through our website www.northstarhydraulics.com, email, or other direct sales channels.

By placing an order, you acknowledge that you have read, understood, and agreed to these Terms, as well as our Privacy Policy and Return Policy.

1. Definitions

• “Products” – Hydraulic cylinders, components, and related goods manufactured or distributed by NorthStar.

• “Purchase Order” – Any written, emailed, or online order confirmation accepted by NorthStar.

• “Customer” – Any individual, company, or organization purchasing from NorthStar.

2. Pricing and Taxes

• All prices are listed in Canadian dollars (CAD) and subject to change without notice.

• Prices exclude applicable federal, provincial, and state taxes, which will be added at checkout.

• For U.S. orders, import duties, customs fees, and brokerage charges are the responsibility of the Customer.

• Any environmental or disposal fees required by local laws are also borne by the Customer.

3. Payment Terms

• Full payment is due prior to shipment, unless otherwise agreed in writing.

• We accept major credit cards and secure electronic payments through Wix Payments, Stripe, or PayPal.

• Credit terms may be extended to established B2B customers upon approval.

• Overdue invoices are subject to an interest charge of 1.5% per month (or the maximum allowed by law).

4. Order Fulfillment and Shipping

• Orders are shipped from our Ontario warehouse, Monday to Friday (excluding statutory holidays).

• Orders are typically dispatched within one (1) business day, unless otherwise delayed by courier pickup availability.

• Shipping rates are calculated based on weight, dimensions, and destination.

• Risk of loss transfers to the Customer once the shipment is picked up by the carrier or delivered locally.

• NorthStar is not responsible for shipping delays caused by carriers, weather conditions, customs processing, or other circumstances beyond our control.

5. Custom Orders and Special Products

• Custom-built, modified, or OEM-specific products (including non-standard lengths, fittings, or finishes) are final sale and non-refundable.

• Custom orders may require a non-refundable deposit.

• Once production has begun, cancellations or changes cannot be made.

6. Returns and Exchanges

Please refer to our Return Policy for full details.

• Products may be returned within 15 days for a refund or exchange.

• Returns between 16–45 days are subject to a 20% restocking fee.

• Returns after 45 days are not accepted.

• All items must be unused, in original packaging, and include a valid RMA (Return Merchandise Authorization).

• Custom products, gas-powered equipment that has been used or fueled, and clearance items are non-returnable.

7. Product Warranty

NorthStar warrants its products to be free from manufacturing defects in materials and workmanship for one (1) year from the date of purchase.

This warranty excludes:

• Damage caused by improper installation, use, or maintenance

• Normal wear and tear or misuse

• Unauthorized repairs, disassembly, or modifications

• Corrosion due to environmental exposure or lack of storage care

To file a warranty claim, contact info@northstarhydraulics.com with a written description of the issue and product details.
We reserve the right to inspect, repair, or replace the product at our discretion.

8. Limitation of Liability

To the fullest extent permitted by law:

• NorthStar shall not be liable for indirect, incidental, or consequential damages, including loss of profit, downtime, or injury caused by misuse or malfunction.

• Our total liability shall not exceed the original purchase price of the product.

9. Intellectual Property

All content on our website — including text, images, designs, catalog data, and logos — is the exclusive property of NorthStar Hydraulics Inc.
No part may be reproduced, copied, or distributed without prior written authorization.

10. Force Majeure

NorthStar shall not be liable for any delay or failure to perform due to events beyond reasonable control, including but not limited to:

• Natural disasters

• Transportation disruptions

• Labour strikes

• Supplier shortages

• Global trade restrictions or government actions

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
For U.S. customers, cross-border transactions are subject to Canadian jurisdiction, unless otherwise required by local law.
Any disputes shall be heard exclusively in the courts of Ontario, Canada.

12. Amendments and Updates

NorthStar reserves the right to modify or update these Terms at any time without prior notice.
The latest version will always be posted on our website and will apply to all future transactions.
